As employment law solicitors, we would like to reemphasize that where an employee breaches any warranty contained in a compromise agreement, the employer has the right to demand repayment of the redundancy payment made, where this was made as an enhanced payment. That is, the payment made was not simply in accordance with statutory redundancy.

Employees must ensure they are certain about the warranties they give in the compromise agreement and that they will not breach them.
