When advising clients on redundancies, we often clarify that the severance payment would be an ex gratia payment made to an employee by his or her employer. This could take the form of a statutory redundancy payment or an enhanced payment, which would include the statutory element. It is up to the employer what it pays and will depend on the employer’s policy. However, one should bear in mind that, if an employee refuses to sign the compromise agreement, the employer can only offer statutory pay.
