			<content:encoded><![CDATA[<p>Typically, employers simply state that they would provide a reference for an employee who has been made redundant or dismissed.  However, some employers are going the further mile and adding terms such as:-</p>
<p>&#8230;The employer shall on request for a refererence,  provide the employee&#8217;s prospective employers with a written reference substantively in the agreed terms and deal with any oral enquiries in the spirit of that agreed reference.  The employer may amend the reference and respond to oral enquiries as may be necessary (i) to reflect the discovery of any material facts not known to the employer at the date of this Agreement; and/or (ii) if the reference is being requested in connection with a regulated role, to ensure the employer complies with the duties imposed upon the employer  in relation to such regulatory body and any applicable laws.</p>

			<content:encoded><![CDATA[<p>An employee must ensure that any reason given by an employer in a compromise agreement for the employee leaving his/her employment is accurate.</p>
<p> Commonly, compromise agreements will say “your employment shall terminate on the Termination Date by reason of redundancy” or “your employment shall terminate on the Termination Date by mutual agreement”.  It is not unheard of for a compromise agreement to state that an employee’s employment will terminate “due to capability”, where this assertion might be contended by the employee, so it is important that an employee attempts to negotiate such expressions out of the compromise agreement as this could have an adverse effect on the employee&#8217;s endeavours to secure subsequent employment. The reason being that an employer could refer to this reason for leaving in the employee&#8217;s reference.</p>

			<content:encoded><![CDATA[<p><span style="color: #003366;">If you have been made redundant and have been asked to sign a compromise agreement, then your employer usually would provide you with a reference.  Your employer in the future will be subject to the confidentiality provisions set out  in your compromise agreement (which you both will sign), so if your employer receives any written reference requests for you, your employer will usually answer these factually and in line with its policy. In some cases that we are seeing, certain employers will provide the following details only in a reference:- </span></p>
<ul>
<li><span style="color: #003366;">Your dates of employment</span></li>
<li><span style="color: #003366;">Your  job title</span></li>
<li><span style="color: #003366;">Your department</span></li>
<li><span style="color: #003366;">Your salary</span></li>
<li><span style="color: #003366;">Your reason for leaving (which should be included in your offer letter and compromise agreement)</span></li>
</ul>
