A number of employees that our employment lawyers are seeing are failing to appreciate the importance of their oiffer. At this stage it is only an offer and the offer could be withdrawn if you intend to and fail to accept it by the prescribed time.</p>

			<content:encoded><![CDATA[<p>One of the issues that employees tend to face is when they can start looking for a new job if faced with redundancy. You can start straightaway, but if offered a job the employee must inform the employer as one of the provisions in a compromise agreement is that at the date of signing the compromise agreement the employee has not been offered a job:</p>
<p>&#8230;The employee warrants as a strict condition of this Agreement that, as at the date of this Agreement,  the employee has not:</p>
<p> (a)        been offered any employment or consultancy or similar earning activity by any person, company, firm or other organisation whatsoever,</p>
<p> (b)        received an indication from a third party that you may receive such an offer  from any specific company, business entity, person or organisation, or</p>
<p>(c)        accepted any such employment or consultancy or other similar earning activity&#8230;.</p>
<p>The employee should ensure that this is brought up during negotiations. If the employee accepts the offer of a new job and signs the compromise agreement with this provision in it, the employee would be in breach of warranty and may have to repay some of  the settlement pay to the employer.</p>

Usually a vlaue will be put on the car by the employer, but still favourable to the employee.   The employee is usually asked to confirm in writing that the employee would like to pruchase the car and have a deadline by which to do so after the termination date, thereafter the offer lapses.</p>

<p>In most cases, we would ask  the employee to sign a disclaimer to protect us in case this employee claims in the future, that he/she did not fully comprehend what he/she was signing.</p>
<p>We take this very seriously.</p>

			<content:encoded><![CDATA[<p>Even if you instigate redundancy or you are chosen for redundancy, there is usually some room to try and improve your offer from your employer.  You can only ask but you must be able to justify why the offer should be increased. You must have a valid reason in order to persuade your employer to increase the offer. Also, as we said before, please ensure that your holiday pay is taken into account .</p>
<p>These would be without prejudice discussions so you would not  be able to rely on them in a Tribunal action or in court proceedings (if you sign a compromise agreement then remember you cant bring any Tribunal or court proceedings).</p>
<p>Once the offer is revised, you mustensure that the offer is correctly represented in your compromise agreement.</p>
