<p><span style="color: #000080;">The Employer agrees that, subject to its legal or regulatory obligations to third parties, it shall not make or publish any derogatory or disparaging statement concerning the Employee or do anything which is intended to or which might be expected to damage or lower the Employee&#8217;s reputation.</span></p>
<p><span style="color: #000080;">In a number of cases, Employers have refused to agree to such a wide provision.</span></p>
